These Terms of Service (“Terms”) govern your use of RequestIn (“RequestIn,” “we,” “our,” or “us”) and the services we provide through our website and app (the “Platform”). By using the Platform, you agree to these Terms.
RequestIn provides a platform where audience members can request songs from bands and pay the bands for those requests. RequestIn does not perform music services, and does not process payments itself.
Customers. May browse, request, and pay for songs.
Bands (Connected Accounts). May receive requests, perform songs, and receive payouts via Stripe Connect after completing Stripe’s onboarding.
Processor. Payments are processed by Stripe. By using RequestIn, you also agree to be bound by Stripe’s Services Agreement and applicable Stripe Connect terms.
Payouts. Bands must successfully onboard with Stripe to receive payouts; Stripe, not RequestIn, handles settlement of funds.
Platform Fee. RequestIn charges a platform fee of 0.85% per transaction with a $0.17 minimum, in addition to Stripe’s processing fees. Depending on your settings, these fees may be added to the customer’s price at checkout. We may update our platform fee with notice posted on the Platform.
Taxes. Bands are responsible for all applicable taxes on their earnings.
Refunds. Refunds are handled by the band directly via Stripe. RequestIn does not issue refunds. (Note: Stripe’s processing fees and RequestIn’s platform fee may be non-refundable per Stripe’s and your settings.)
Disputes/Chargebacks. If a customer disputes a charge, the dispute is handled through Stripe’s dispute process. Any dispute fees, losses, or reversals are the responsibility of the band as merchant of record.
RequestIn is a platform provider that enables customers to submit requests to bands. As described above, payment processing is provided by Stripe. RequestIn is not a party to transactions between customers and bands, does not handle, hold, or control funds, and does not guarantee the performance of any band. The band is the merchant of record and is responsible for refunds and chargebacks.
Local Laws & Compliance. RequestIn may be used in varied venues and jurisdictions. Bands are responsible for compliance with all applicable laws, taxes, permits, venue rules, and licensing requirements. RequestIn does not provide legal, accounting, or tax advice.
Your use of the Platform is also governed by our Privacy Policy.
We may suspend or terminate your access to the Platform if you violate these Terms or misuse the service. You may stop using the Platform at any time.
The Platform and its content are owned by RequestIn or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for its intended purposes, subject to these Terms.
You agree not to (a) interfere with or disrupt the Platform; (b) attempt to access non-public areas; (c) reverse engineer or scrape the Platform except as permitted by law; or (d) upload content that is illegal, infringing, or harmful.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, REQUESTIN DISCLAIMS ALL WARRANTIES (EXPRESS OR IMPLIED), AND WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TO THE EXTENT PERMITTED BY LAW, REQUESTIN’S TOTAL LIABILITY FOR ANY CLAIMS WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNTS YOU PAID TO REQUESTIN (EXCLUDING AMOUNTS PAID TO BANDS) IN THE 12 MONTHS BEFORE THE CLAIM.
You agree to indemnify and hold harmless RequestIn from claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Platform or violation of these Terms.
We may update these Terms from time to time. The updated version will be posted with a new effective date. Material changes will be notified through the Platform or by email when practicable.
These Terms are governed by the laws of the State of Tennessee, without regard to conflicts of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Davidson County, Tennessee for any dispute not subject to arbitration (if an arbitration clause is later added).
